U.S. Turf Company endeavors to use the highest quality materials and the latest manufacturing techniques in the production of Synthetic Turf. Our products are manufactured within our manufacturing tolerances. The fibers and backings used are independently guaranteed. The U.S. Turf Company guarantees against defects arising exclusively from the installation of synthetic turf products for a period of (2) years from the date of installation.

The term “Synthetic Turf”, as used herein, shall only include turf installed by U.S. Turf Company. This guarantee shall not cover any defects, failure or damage in or to the Synthetic Turf, which is: subject to abuse, misuse, negligence, installed, repaired, altered or replaced by any person other than a qualified installer trained by U.S. Turf Company damaged, directly or indirectly, including by not limited to, on account of, accident, vandalism, burn, cuts, machinery, spiked shoes, inappropriate footwear, sports equipment, animal digging, animal chewing, pile crushing or matting of turf, damage caused by reflection(melting) or other flammable materials, damage of melting of fibers of any kind, misuse, fire, flood, chemical reactions, herbicides, pesticides, wear and tear or abrasion caused by misuse, use of improper cleaning methods, failure to properly maintain, protect or repair the product or turf, chlorinated water from swimming pools, acts of God, static or dynamic loads exceeding U.S. Turf Company specifications at time of installation, improper or faulty subsurface preparation, failure of the subsurface after installation (including settling of the subsurface), placement of play set equipment, placement of lawn furniture, and the use of dry cleaning fluids or improper cleaning methods, exposure to any light other than natural light. All synthetic turf is subject to normal wear and tear and is not a manufacturing defect and not covered by this guarantee.

The guarantee is expressly in lieu of all conditions and guarantees expressed or implied in fact of by law or otherwise, including without limitation, any implied conditions or warranties as to merchantability or fitness for a particular purpose. No person or party is authorized to create any obligation or liability for U.S. Turf Company and only the guarantee expressed herein shall apply. The U.S. Turf Company has the obligation under this guarantee, that it is restricted to the repair or, at its sold option replacement of the affected parts covered herein. U.S. Turf Company liability under this guarantee is limited to the material value of the item to be repaired or replaced and any additional costs necessary for materials or labor necessary to repair or replace “Synthetic Turf” to the original installation condition.

The remedy of repair or replacement set forth herein shall be sole discretion of the U.S. Turf Company and shall have no other obligations or liability in connection with any matter or thing, including without limitation, damages for personal injury or damages related to lost revenue, increased costs, downtime costs and all other indirect or consequential damages. The U.S. Turf Company will not be liable in any manner for damaged driveway, walkway, pool decks, patio, fences, gates, shrubs, trees, existing landscaping, retaining walls, sprinkler system, personal property of the purchaser, purchasers tools, low voltage lighting. Purchaser may not transfer, convey, or otherwise assign all or any of its rights under this guarantee without written consent of the U.S. Turf Company. Any such transfer or assignment without prior written consent shall be null and void and of no effect.

U.S. Turf Company endeavors to handle all Guarantee claims promptly and professionally conditioned on purchaser’s contract has been paid in full at time of claim.

It is agreed, that all claims by purchaser, made under the foregoing guarantee, shall be invalid, null and void, unless made in writing to U.S. Turf Company within (2) two years from date of installation and within (15) days of learning of the cause and giving rise to its claim.
